The present sales conditions are finallised,from one part by the society LLC TROISIEME POLE, with a capital of 20 000€ whose head office is situated at 5 Avenue des vendanges, 34150 FLORENSAC, registered at the comercial and societies of Beziers register under the number SIREN 499 120 319 below « TROISIEME POLE » and on the other hand, by any physical or moral person whishing to proceed to a purchase via the website of FLORES-LES VIGNERONS DE FLORENSAC named below « the client ».
OBJECT OF THE CONTRACT
The present general sales conditions have for purpose to set the contractual disposition between FLORES-Les vignerons de Florensac- and the client and the applicable conditions for any purchase done via the merchant site www.flores.vin, for the consumer. The purchase of wine throughout our shop on line involves an acceptation with no reserve by the client of the present conditions of sale.
INFORMATIONS LEGALES
The ruling n° 59-107 of January, 7th.1959 and the law n° 74-631 of July, 5th. 1974 prohibts the sale and the offerr of alcoholic beverage to underage person and equivalents. Therefore, filling in your order form, you acknowledge getting the juridicial capicity to conclude the present contract.
In application of the IT law and liberty, the requested information are essential to the treatment of your order and are aimed to the services of FLores-Les vingnerons de Florensac.
You have at your disposal a right of access, modification, end and rectification related to your personal data.

FEATURES OF THE ARTICLES PROPOSED TO THE SALE
The proposed items are those that are in the shop on line on the website www.flores.vin. These items are proposed in the limit of the available stocks. Each of them is accompanied with a description set by Florès-Les vignerons de Florensac.
The photos and graphisms presented on the internet site www.flores.vin are the most faithful as possible but cannot assure a perfect similarity with the proposed item. They are not contractual and couldn’t involve the responsability of the seller.
GEOGRAPHICAL AREA
The sale on line of items presented in the site are reserved for the purchasers living in metropolitan France.
RATES
The prices appearingon our site are prices TTC in euros taking account of the VAT applicable the day of t he order. Any rate changement is able to be impacted on the price of the items.
Florès- Les vignerons de Florensac- keeps the right to modify its prices at any moment ; only the price indicated on the site the day of the order will be applied to the client.
Any refund won’t be made in case of price decrease.
The prices indicated on our bottles don’t include the shipping costs that are in the exclusive charge of the client.
These price are exclusively available for the metropolitan France.
The fees of delivery are charged in extra, in the indicated conditions on the shop on line, and calculated previously when placing the order.
The requested payment to the client corresponds to the total amount of the purchase, including the delivery fees.
ORDERS
The client places an order on the website : www.flores.vin.
To buy one or several items, he must mandatory follow the following process :
- Choice of items and adding to the basket
- Validation of the basket content
- Identification on the website and subscription on the identification note card on which he will indicate all the requested contact details
- Choice of the payment mode and acceptation of the SGC
- Validation of the payment
The sales are only made by box of 6 bottles of 75 cl each and with a minimum order of 1 boxe.
The client will receive a confirmation of the order by e-mail.
The client will be able at any moment to visualise the detail of his order during the process of order as well as its total price and, thus, correct occasional errors before confirming to express his acceptation.
Florès – Les vignerons de Florensac- keeps the property of the items till the complete payment of the order, in other words till the receipt of the item price.
Florès – Les vignerons de Florensac keeps the right to cancel ou to refuse any order that would come from a client with whom there would be a litigation related to a previously order or a client who wouldn’t be able to take out a contract.

In case of unvailability of the product, we commit to warn as soon as possible the client who will be able to modify or cancel his order. The unvailibility of the product wouldn’t commit our responsability, neither opening rights to damages for the client.
PAYMENT MODALITIES
The payment of the purchases is made via on of these two means, at the convenience of the client:

SHIPMENT AND DELIVERY TIME
Any placed and paid order on the website ww.flores.vin before midday from monday
to friday (except bank holiday) will be shipped within 3 days under reserve of payment validation.
The delivery time can take between 3 and 7 days from the acceptance and payment of the order on the site.
The delivery time are just given for indication only and, can’t give rise to an order cancellation from the client, nor to a request of damages in case of a delay due to any event.
Our responsability wouldn’t also be invoved in case of non-respect of delivery consignment transfered to the haulier (date, schedule, delivery notice). All of our sendings are shipped in solid and safe packagings. The hauliers are entirely responsible of road damages. Even shipped free of charge, the goods travel at recipient’s own risk. On receipt, the latter must carefully check the conformity and the state of the delivered products. Any irreguarity noticed (missing item, damaged parcel, broken item…) should be consigned currately on the delivery form of the haulier, and, then, confirmed by e-mail within 48 hours (eboutique@flores.vin).
Without such a notification, any exchange or refund will not be done.
In case of non-conformity of the delivered product compared to the ordered product, contact us within the 7 days following the reception of the good. We will exchange the product in the shortest time.
The delivery cost will be calculated depending on the number of bottles and on the department/region.
The shipment conditions are valid for any customer at a unique delivery.
Shipments only in metropolitan France. Any shipment abroad is not possible.
The delivery of our products are left to an independant haulier.
Important : thank you to communicate any piece of information necessary to the good proceedings of the delivery (code of the door, presence of a keeper, neighbour or someone else who could receive your boxes in case of absence). The deliveries are made at the door step( no delivery upstairs-contact us for extra).
BREAKING DURING THE SHIPMENT
If a parcel arrives damaged at the recipient (breakingof one/several bottles), the recipient must refuse it. The haulier will take in charge to inform Florès-The winemakers of Florensac.
On receipt of this piece of information, Florès-The winemakerss of Florensac commits to reshipping immediately a similar parcel to the recipient. In no any case, the client will be able to demand the refund of the product and of the flat rate of the delivery.
RETRACTION TIME : EXCHANGE OR RETURN
In application of the articleL. 121-16 of the code of the consumption, you have the possibility to return, at your expense, at our head office address, the product in a time of 14 days (law HAMON, 13th june2014) as of the delivery, for exchange or refund, in good state and in its original packaging with its original invoice.
The retraction right statement can be made by e-mail at eboutique@flores.vin.
In case of the right of retraction in the above-mentioned time, only the price due or products bought and the fees of delivery are refund, the fees of return are at the charge of the client.
EXCHANGE AND RETURN CONDITIONS FOR A REFUND
The returned items must be safe, unopened and in perfect state.
They will have to be resend in a state permetting their re-commercialisation.
The client will have to keep the proof of the parcel deposit to the service provider in charge of the return.
In the absence of this proof, no exchange or refund can be made in case of loss of the package.
RESPONSABILITY
The responsability of Florès – Les vignerons de Florensac wouldn’t be involved in case of non-implementation of the contract, in case of disruption of stock ou unavailability of the product, force majeure and, particularly in case of total strike or partial, flooding or other natural disasters ; in general way all events that don’t permit the good execution of the order.
In application of the article L. 3342-1 of the code of the public health forbidding the sale of alcohol to underages(less than 18 years old), the client commits validating his order , to be over 18 at the date of the order.
ELECTRONIC SIGNATURE
The “OK” associated to the process of authentification and of non repudiation and to the protection of the entirety of messages constitute an electronic signature. This electronic signature has the value, between the parts, of a written signature.
PROOF
The computerized registers, keep in the computerized systems of Florès-Les vignerons de Florensac-in raisonnable conditions of security, will be considered as communication proofs, orders and payments come up between the parts.
LITIGATION SETTLEMENT
The present general conditions of sale above are governed by French law. Our Customer Service is at your disposal for the settlement of any dispute and in the absence of an amicable solution, only the Courts of Béziers will be competent.

The abuse of alcohol is dangerous to health, consume with moderation.
